Reality Events Terms and Conditions
EVENT AND PARTY HIRE AGREEMENT

The following Terms and Conditions must be accepted by the “Hirer” prior to hiring any equipment.

This “Hire Agreement” is the agreement between The Owner and Hirer for the hire of the Equipment.

Definitions:
“Agreement” – this agreement between the Hirer and the Owner.
“Hirer” – a person, firm or company hiring any items from the Owner.
“Owner” – is Reality Events.
“Hire Items” – all equipment provided by the Owner
“Hire Date” – date items are being hired

PAYMENT & BOND
1. The full payment is required to secure your booking. Items cannot be reserved until full payment has been received. We have added After Pay for your convenience which means that you can pay in 4 installments allowing you to shop now & pay later. If you are unable to pay using afterpay, you may request to pay via a payment plan. The payment plan must be paid over 3 seperate installments and paid in full no later than 2 weeks before the event date.
2. The hirer is responsible to review each individual product on our website and read product descriptions to ensure it is suitable.                                                                3. We do not require a bond however if any hire items are damaged the hirer will be liable to pay the replacement fee as listed on our website. Please see more details regarding this below.

DAMAGES OR LOSS
1.The Hirer shall be responsible for any loss or damage to the Equipment irrespective of how the loss or damage occurred, except for fair wear and tear, during the hire period.
2.The Hirer is liable for the payment of the replacement value or cost of repairing the equipment if damaged as per the replacement fee list.
3.The Hirer agrees that if the equipment is damaged or missing, the replacement fee will be issued and paid within a 2-week timeframe. Failure to pay the invoice within the timeframe will result in payment being drawn from the Hirers account.
4.Interest will accrue if payments are not made on time or if delayed periods of payment occur.
5.The Owner & Staff members quality check hire items on a regular basis to ensure there are no issues or delays with any bookings. However, the Owner acknowledges items may fail due to circumstances out of their control and the hirer exempts the owner from responsibility in these instances.

CLEANING
1.The Equipment shall be delivered in a reasonably clean, but not necessarily sterile, state. The Hirer must satisfy itself as to the sterility of any Equipment, particularly from which food or drinks are to be served, prior to use.
2.The Owner will charge a cleaning fee if cleaning requirements are not met e.g. Dirty Glasses, Stains, Food Stains, Dirt, Sticker or Tape residue etc. The hirer is responsible to remove any stickers, decal, floristry, balloons prior to collection.
3.The Hirer must have Equipment organised & packed up at the end of the Hire Period in a complete, clean, and dry state.
If hired Equipment is not cleaned, the cleaning fee will automatically be drawn from the hirer’s account

CANCELLATION & COVID
1. The Hirer may cancel an order but shall forfeit any hire fees paid as follows:
a) 40% of booking payment is non-refundable and is 100% forfeited to the owner once paid.
(b) Any Bookings cancelled by the Hirer in writing within 2-4 weeks of the function date shall forfeit 50% of the total hire fee
(c) Any Bookings cancelled by the Hirer in writing less than two weeks of the function date shall forfeit 100% of the total hire fee
(d) Any adjustments or cancellation of hire items must be made 2 weeks prior to hire/event date. Fees apply for changes/cancellations outside of this time frame.                   (e) If you wish to postpone, we require two weeks notices & this will be subject to our availability. The new booking date must be booked within 6 months of the original booking date. We will not offer any credit after this timeframe & any monies paid will be forfeited. 

2. ANY Cancellations due to Covid-19 will NOT be refunded. We can postpone and reschedule your booking subject to availability. Any monies paid will be credited to a future event.

DELIVERY AND INSTALLATION
1.The Owners will do their best to deliver and install during agreed time frames however if the owner cannot deliver for whatever reasons including but not limited to; severe sickness, severe weather conditions, traffic delays, car accidents, or vehicle breakdowns, the hirer will not hold them liable for any loss or damages suffered.
2.If through circumstances beyond the control of The Owner, it is unable to provide the Equipment, then The Owner may: Make changes to the Equipment provided or Cancel any order by notice in writing.
3.It is the hirer’s responsibility to make sure the venue, functions manager and staff are aware they are unable to move our hire items listed above. If the venue advises the backdrop will need to be removed by a specific time to avoid the backdrop being handled, the client will be charged accordingly if a late-night collection is required.
4.Additional fees will be incurred;
(a) for any public holiday bookings – 15% surcharge
(b) for deliveries or collections between 7pm-7am
(c) for deliveries requiring more labour or staff
(d) for deliveries with a significant distance to access
(e) for deliveries that are NOT on ground level and require use of stairs or elevator or escalator to access event space

COLLECTION & DROP OFF TIMES
1.The pick up and/or return times must be within the Collection and Drop-Off Times as stated on www.rhiality.com.au under the “COLLECTION & DROP-OFF TIMES” heading.
2.If the hirer is not present at the agreed collection time, within the stated collection times, the hirer will forfeit their ability to collect the hire item(s) and any 3.payment(s) will not be refunded.
4.If the hirer is not present at the agreed drop-off time, within the stated drop-off times to return the hire item(s), the hirer will be responsible to pay a late fee of $50.00; additional fees will also be incurred for each late calendar day at the full-hire rate.
5.Early or Late Return of Equipment: If the Hirer wants to return the Equipment before or after the end of the Hire Period, the Hirer must contact the Owner/Staff first to arrange a suitable time. Late Fee’s will apply if the hire items are returned later than 48 hours after collecting the hire items. 

LIABILITY
1.The Hirer agrees that the use of the hire items carries with it dangers and risks of injury and the Hirer agrees to accept all dangers and risks associated with the products and services offered or supplied by the Owner.
2.The Hirer shall have the responsibility of all risks and liabilities for, and in respect of, the Equipment and for all injuries to or deaths of persons and any damage to property.
3.The Owner is at no time liable for any risks or liabilities resulted from to the usage of the Equipment, products or services supplied and is not liable for any injuries to or deaths of persons at any time. 4. The Hirer is responsible to organise any licenses or permits if required for any hire items which are displayed and used in any public places. 

REFUSAL OR TERMINATION OF HIRE
1.The Owner and/or Reality Events Team member has the right to refuse a booking or terminate the hire at any time if is believed any hire items are subject to damage or danger, items are not suited for the purpose of the clients hire. Termination of hire without a refund may also apply if hire items do not fit in clients proposed event space, will be exposed to poor weather conditions, etc.

PHOTO & SOCIAL MEDIA
1.The hirer consents to Reality Events using any pictures for marketing purposes.
2.Any photos or videos of our hire products taken during the event that you share, may be included on our social media pages. Please advise us if you wish for photos not to be used/displayed.

WEATHER CONDITIONS
1.The Hirer accepts that all hire items are not suited in bad weather conditions and understands that Reality Events may refuse use of items in particular areas if deemed unsafe. If the Hirer has hire items outside & it begins to rain throughout the event, all hire items must be moved inside or undercover immediately by the hirer. If hire items are returned wet and need to be dried out to avoid damage such as mold, additional fees will apply. 
2.It is the hirers responsibility to have a plan B in case of inclement weather (including windy conditions).
3.If the hirer requests to postpone due to the weather, 2-days notice is required. Reality Events will reschedule your booking if required, subject to availability. You have 1 month to reschedule your booking, if you fail to rebook within this timeframe your booking will be cancelled. 
4.If the hirer requests to cancel due to the weather the same cancellation conditions apply as listed above. 

SOFT PLAY EQUIPMENT

  1. The Hirer has read, understands and accepts Reality Events ‘Terms of Use’ for all Soft Play Equipment.
  2. It is the responsibility of the Hirer to ensure that due care and attention is given to avoid damage to the Soft Play Equipment and injury to its users.
  3. The Hirer understands that if at the time of set up the minimum space is not provided that no refunds will be provided for these items and funds will be forfeited.
  4. The hirer must provide a Plan B Option (Indoors/Undercover Area) at the time of booking, if requesting to use the Soft Play Equipment Outside. If it is forecasted to rain, or the location is deemed unsafe due to wet/muddy grass areas Reality Events reserves the right to request the Hirer to proceed with their Plan B location. If the Hirer refuses to proceed with their Plan B Option Reality Events reserves the right to cancel the booking and no monies will be refunded. 
  5. Any damages, losses, or cleaning fees will automatically be drawn from the clients Bond (if bond applied) . If any damages, losses, etc exceed the bond amount the hirer will be charged the remaining balance. Clients who did not pay a bond will have 14 days to pay the invoice for the damages. Failure to pay the invoice within the timeframe will result in payment being drawn from the hirers account. 
  6. If the Reality Events team is setting up & arrives at the event location and is not advised at the time of booking of any stairs or excessive distances that will be incurred to set up the equipment, the staff member on duty has the right to decline the use of the equipment and all monies will be forfeited.

PRODUCT SUPPLY AGREEMENT – Whilst every effort is maintained to supply products as close as practically possible as photos and images shown on our website and advertising, some products may vary from the image(s) shown. Whilst every effort is made to provide excellent customer satisfaction, particular care should be given in regards to actual product colours, which may vary from product to product and may vary from the exact colour shown on your monitor. We encourage you to contact us, prior to purchase (or hire) of products to discuss colour variances should this be of particular concern to you.
